THE BUSINESS CLOSURE PORTION OF EXECUTIVE ORDER 2020-07
EXTENDED BY FIFTH AMENDED EXECUTIVE ORDER 2020-13 THROUGH MAY 30, 2020
KEY UPDATES:
- Effective April 24, 2020, all businesses should, unless the local municipality has more stringent guidelines, adhere to the statewide Open Up and Recover Safely (OURS) Plan as provided on the Oklahoma Department of Commerce website.
- Pursuant to the OURS Plan, businesses may begin reopening as follows:
- The following businesses can reopen on April 24, 2020:
- Personal care businesses, such as hair salons, barbershops, spas, nail salons, and pet groomers can reopen for appointments only, must adhere to sanitation protocols, and follow guidelines posted on the Oklahoma Department of Commerce website regarding social distancing between customers and visitors at personal care businesses.
- State parks and outdoor recreation should be reopened.
- Grocery stores should continue to maintain hours for vulnerable populations.
- The following businesses can reopen on May 1, 2020:
- Dining, entertainment, movie theatres and sporting venues can operate using CDC-recommended social distancing and sanitation protocols.
- Gyms can reopen if they adhere to CDC-recommended social distancing and sanitation protocols.
- Places of worship can reopen for in-person meetings or worship if they leave every other row or pew open and adhere to CDC-recommended social distancing and sanitation protocols, plus the recommended guidelines from the Oklahoma Department of Commerce.
- However, BARS MUST REMAIN CLOSED.
- Tattoo Parlors can reopen for appointments only and must adhere to sanitation protocols and social distancing protocols for distancing between customers and visitors.
- Phase 2 will begin on May 15, 2020 if all Phase 1 guidelines are met. Under this Phase, the following businesses may open:
- Bars can operate with diminished standing-room occupancy, where applicable and appropriate, and under social distancing and sanitation protocols.

KEY UPDATES:
- The business closure part of the order is in effect until April 30, 2020. The other parts of the new Order are in effect until May 8, 2020.
- The previous Order closed businesses that were both on the CISA List and were in selected designated counties that had Covid-19 infections. The new Order closes businesses statewide unless they are on the CISA List or on the list of essential business by OK Department of Commerce.

Executive Summary
Oklahoma Fourth Amended Executive Order 2020-07 on March 24, 2020 and Amended Executive Memorandum 2020-01 on March 25, 2020 requiring the closure of all businesses not identified as being within a critical infrastructure sector and located in a county experiencing community spread of COVID 19 as identified by the Oklahoma State Department of Health on its website. The order and memo exempt from closure businesses and industries on the federal CISA List and on a separate Oklahoma Essential Industries List issue by the Oklahoma Department of Commerce.
Summary of Order
- The Oklahoma orders were issued on March 24 and 25, 2020, respectively. pursuant to Nevada’s Emergency Declaration issued on March 12, 2020.
- The order and memo took effect on March 25, 2020 at 11:59 p.m., and remain in effect until April 16, 2020.
- Pursuant to the order and memo, all businesses not identified as being within a critical infrastructure sector as defined by the U.S. Department of Homeland Security and located in a county experiencing community spread of COVID-19, as identified by the OSDH on its website, were ordered to close.
- Additional sectors may be designated as critical by further executive order or memorandum, and restaurants and bars are still permitted to provide pick-up, curbside, and delivery services.
- For purposes of the order and memo, businesses and industries deemed essential within a critical infrastructure sector include those on the CISA List as well as those in the following sectors:

- Non-essential businesses that wish to be considered essential may request an exemption and/or clarification regarding their status by with the Oklahoma Essential Business Inquiry Form.
Social Distancing Requirements
Businesses operating within the CISA critical sectors should take proactive measures to ensure compliance with social distancing recommendations, including:
- Designate six-foot distances.
- Having hand sanitizer and sanitizing products readily available for employees and customers.
- Implementing separate operating hours for elderly and vulnerable customers.
- Posting online whether a facility is open and how best to reach the facility and continue services by phone or remotely.
